The United States government has proposed changes to the H1B visa process, which has raised curiosity among thousands of Indians who are planning to avail the H1B visa in the near future.
According to the US Department of Homeland Security, the proposed changes to the visa process for H1B visas aim to define eligibility requirements, assist both employers and workers, and more.
Here, the visa application process, proposed changes and all the details are detailed.
What is H1B visa?
H1B visa to the United States is for non-immigrants and thousands of Indians avail it every year. It allows companies in the US to hire foreign workers, especially for jobs that require technical knowledge.
Employers usually hire workers for a period of three to six years in most cases. It should be noted that people who apply for a green card in the United States while still on their H1B visa can seek renewal of their visa.
The US issues 65,000 H1B visas every year, apart from 20,000 applications for those who have at least a master’s degree from an American institution.
All applicants must register with US Citizenship and Immigration Services; Once registered, applicants are selected through an H1B visa lottery system.
Changes in H1B Visa Process and Implications
The proposed changes to the H1B visa process are aimed at streamlining the application process, providing assistance to employers as well as applicants and are also said to be “aimed at strengthening integrity measures.”
America’s Homeland Security Department has also said the same thing. Its Secretary Alejandro N. Mayorkas said the Biden administration aims to attract global talent, prevent any fraud in the immigration process as well as reduce the burden on employers with the proposed changes.
It is expected that after the changes are implemented, applicants will not be able to submit more than one application and all applicants will get equal opportunity. It could also exempt workers from the H1B visa lottery system, making it easier for both parties involved.
It is also seen as a way to regulate employers by only hiring people with expertise rather than general qualifications.
When will the changes come into effect?
It is to be noted that all changes are only proposals at this point, and will not be implemented immediately or without feedback and input. The changes are expected to take at least six months or more to implement.
Does this affect passengers?
The H1B visa is for employment purposes only in the United States and any proposed changes are not for tourist visas. Travelers wishing to visit the states will have to apply for a tourist visa and follow the prescribed procedure, regardless of any changes in the H1B visa process.
