New Delhi: The Ministry of Road Transport and Highways has invited suggestions from the public and all stakeholders on the proposal to amend the Central Motor Vehicles Rules, 1989. The purpose of this amendment is to enable the motor vehicle owner to nominate someone (Nominee) (named in RC). Format Notification GSR 739 (E), dated 26 November 2020 has been published by the Ministry.
It is proposed to include the nomination facility at the time of vehicle registration. This will help in registering / transferring the motor vehicle to the nominee in the event of death of the vehicle owner. The current process is difficult and is not uniform across the country.
The amendments proposed in the Central Motor Vehicles Rules, 1989 are –
(A) Rule 47, Application for registration of motor vehicle: – It is proposed to include an additional sub-section to which ‘identity proof, if any, of the nominee’ will be added so that the vehicle owner is the legal heir of the vehicle in the event of death of any person. Be able to designate.
(B) Rule 55, Ownership Transfer: – In sub-rule (2), it is proposed to add ‘identity proof, if any, of the nominee’, to include an additional sub-section so that the vehicle owner in the event of death The nominee should be able to nominate a legal heir.
(C) Rule 56, Transfer of ownership in the event of death: – In the case of not specifically designating, it is proposed in sub-rule (2) relating to the transfer of conveyance to the legal heir, including an additional sub-section ‘ Identity proof, if any, of the nominee will be added so that the vehicle owner is able to nominate someone.
(D) It is proposed to add a new sub-rule. As per the proposal of this rule, the transfer of the vehicle in the first specifically designated case will be done in the name of the nominee and the nominee will have to upload the death certificate on the portal informing the registration authorities and applying for new registration in their own name. The portal will be faceless if the Aadhaar is authorized in the selection form. There is a proposal for change in nomination considering special circumstances such as divorce, property sharing, asset transfer without sale. Such nominations follow the agreed standard operating procedure (SOP).
(E) Rule 57, Ownership transfer in the case of a vehicle purchased at a public auction: – In the sub-rule (1) of the application for registration of a motor vehicle, including an additional sub-section, ‘Identity proof of the nominee, if Somebody ‘will be added so that the owner is able to nominate someone in the event of death.
(F) Form 20, Form 23A, 24, 30, 31 and 32 are proposed to be amended. The objective is to include the details of the nominee and the declaration of the registered owner about the inclusion of detailed details of the nominee.
Certificates / orders issued by SDM / DM / Tribunal / Honorable Court can be used to assist in citizen friendly service.
