New Delhi: The High Court on Friday stayed the EDMC’s decision to disqualify Aam Aadmi Party leader Tahir Hussain, who was arrested in a case related to the north-east Delhi riots, for the post of councilor. Explain that the membership of Delhi riots accused Tahir Hussain was canceled by the Municipal Corporation of Delhi, against which Tahir Hussain filed a petition in the High Court.
The court also issued a notice to the corporation representing his permanent lawyer Gaurang Kanth and put his side on the petition till March next year. Advocate Rizwan, appearing for Hussain, confirmed that the court had stayed the EDMC verdict. The plea was made by the former Aam Aadmi Party councilor through his wife.
Councilor Tahir Hussain, who was accused of violence in north-east Delhi, was terminated in the House by the East Delhi Municipal Corporation. This decision was taken after being absent for 3 consecutive sittings in the House. Tahir had been absent from the House meetings in January, February and later in June and July without any notice prior to the violence in February.
In fact, sub-section 2 of section 35 of the Municipal Corporation Act provides that the membership of the concerned councilor of the house can be terminated if a member of the corporation is absent in three consecutive meetings of the house without prior notice. Under this provision, the Municipal Corporation Secretary moved the motion in the House. After discussion, the proposal was unanimously approved by the House. According to the proposal, Tahir Hussain was representing ward number 59E. This seat was vacant.
Explain that no meeting of the Municipal Corporation could be held due to the lockdown from March to May. At the same time, three corporators have also resigned from their membership posts after being elected members of the Delhi Legislative Assembly, which means that the corporation now has only 61 councilors. While 64 wards come under the corporation.
